Use of Content

All logos, brands, trademarks, labels, and names appearing in this App or Website are the properties of SwiftDial or used under license. Unauthorized copying, modification, or distribution of this content without written permission is strictly prohibited.

Acceptable App & Website Use

(A) Security Rules:

Accessing data not intended for you or logging into unauthorized accounts.
Probing or scanning system vulnerabilities without permission.
Disrupting services via viruses, overloading, or other attacks.
Sending unsolicited promotions or spam.

Violations may result in legal action. SwiftDial reserves the right to cooperate with law enforcement authorities in prosecuting violations.

(B) General Rules:

Users may not use the app to encourage illegal activity or violate laws.
Users may not infringe copyrights, trademarks, or other IP rights.
Users may not distribute defamatory, obscene, threatening, or hateful material.

Indemnity

The User agrees to indemnify and hold harmless SwiftDial, its officers, directors, and employees from any claims, losses, or damages arising from misuse of the app or violation of these Terms.

Liability

SwiftDial is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the service, unauthorized access to data, or service interruptions. Total liability shall not exceed the amount paid for the service.

Disclaimer of Consequential Damages

In no event shall SwiftDial or its associated entities be liable for incidental or consequential damages, including loss of data, profits, or business interruption, arising out of the use or inability to use the App or Website.

Governing Law and Jurisdiction

These Terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles. Any disputes arising in relation here to shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

Dispute Resolution (Arbitration Clause)

Any dispute, difference, controversy, or claim arising out of or relating to these Terms, including the interpretation, scope, or termination thereof, shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996.

Arbitrator: The dispute shall be referred to a sole arbitrator appointed mutually by the parties.
Seat and Venue: The seat and venue of arbitration shall be New Delhi, India (or Mumbai, depending on your preference).
Language: The language of the arbitration shall be English.
Finality: The award rendered by the arbitrator shall be final and binding on both parties.

Amicable Settlement (Pre-Arbitration)

In the event of any dispute, the parties agree to first attempt to resolve the matter through mutual discussions and 'Amicable Settlement' or a period of 30 days before initiating any formal arbitration or legal proceedings.
